This website, www.fringefrequency.com, is owned and operated by Aaron Lee (“owner”). This is a privately-owned website, and is currently run by Aaron Lee and volunteers (“we”, “us”, “the Site”, “Fringe Frequency”, or “Fringe Frequency and its contributors”).
By using and accessing Fringe Frequency, you (“you”, “user”, or “end user”) agree to these terms (referred to as the “Terms of Use” or “Agreement”). Please read them carefully.
All information provided on the Site is done so in good faith, and any information taken away is done so at the user’s own risk.
If you do not agree with these terms, please discontinue using this website immediately.
1. Intellectual Property Rights
All material contained on the Site are copyright of fringefrequency.com and its owner. An exclusion to this is content – whether written, photographic, audio or video – created by volunteers for use on fringefrequency.com, in which case copyright remains with those volunteers, unless formally agreed otherwise.
This site uses content owned and created by third-parties, including writers, photographers, publicity representatives, and other licence holders. Fringe Frequency does not own content created by external creators and licence holders. We seek permission to use content we have not created, and credit this material when it is used, whenever possible.
For copyright claims, please see clause 10 below.
You acknowledge and agree that all content and information on the Site is protected by the rights and laws of the United Kingdom.
You agree not to copy, modify, distribute, transmit, display, perform, reproduce, publish, license, transfer, create derivative work from, sell, or re-sell any content or information obtained from or through the Site.
2. Disclaimer of Liability
All content, information and links on the Site are provided for entertainment purposes only. In any event that we provide advice or recommendations, such content is offered as a suggestion only – we do not claim to provide certified educational, medical, legal or other professional advice.
While we do our utmost to ensure the accuracy of everything on fringefrequency.com to the extent permitted by law, we do not accept any responsibility for any statement or content from a third-party in the material.
The Site, and its owner, make no warranty, express or implied, that content will be reliable, uninterrupted, timely, secure or free from errors. The Site may include inaccuracies, technical mistakes, typographical errors, broken links, and other unforeseen errors. Fringe Frequency, and its owner, reserves the right to change the Site content and information at any time without notice.
You use any of the information on our Site at your own risk. You further agree that Fringe Frequency, and its owner, will not be held responsible for any loss caused, whether indirect, incidental, special, punitive or consequential, as a result of your doing, or not doing, anything as a result of viewing, reading or listening to material found on, or through, the Site.
3. Volunteers Agreement
If you create work for, or submit work to, Fringe Frequency, you (the “voluntary team member” or “voluntary contributor” in this instance) hereby agree to the following terms in this point.
This is a privately-owned voluntary website. As such, as a voluntary team member or contributor, you retain copyright for any material you produce, unless formally agreed in writing.
The Site, and its owner, do not claim to own your copyright material. You do, however, grant Fringe Frequency a non-exclusive, royalty-free and irrevocable licence to:
- Publish such material in any media and in any format, including, but not limited to, on this domain or any other subdomain, in hard copy publications, in email newsletters, on social media, mobile alerts, and in web feeds.
If your contributions include material in which copyright or other intellectual property is owned by someone other than yourself, you warrant that you have the secured authorisation to use that material in the licence referred to above.
As a voluntary contributor, you also agree that you will do your best to provide accurate and honest information in all content you provide to Fringe Frequency.
Fringe Frequency, and its owner, aims to operate in a fair, accurate and honest manner. This is an entertainment website, but in the event that we, or a contributor, is tackling a serious issue in the form of an article or comment, we seek to adhere to the codes of practice set out by the UK Editors’ Code of Practice Committee (see The Editors’ Code).
With this in mind, we reserve the right to decline, modify, retract, or remove, anything that does not meet our standards. As a voluntary contributor, any opinions you express are your own, and are not necessarily endorsed by Fringe Frequency, or its owner.
4. Third-party Organisations, Events and Websites
The Site, and its newsletter, may contain links to other organisations and websites.
These links are offered purely as a convenience and does not indicate endorsement of, or association with, the party by Fringe Frequency or its owner.
In the case of events, Fringe Frequency lists events by third parties on its webpages. Information will be sourced from third-party websites, or from the event organisers directly. Material from a third-party will be clearly marked and a link to the source’s website will be provided. These listings are provided to you, the user, purely as suggestions. Fringe Frequency, and its owner, makes no claim to endorse, support, or associate with third-parties hosting events listed on the Site. If you decide to access linked third-party websites, or choose to attend an event you found listed on this Site, you do so at your own risk.
Media content by other private individuals and organisations may also appear on the Site. Fringe Frequency makes no claim to own any content created by these private individuals and organisations. Fringe Frequency provides links to other websites purely as suggestions. Fringe Frequency, and its owner, makes no claim to endorse, support, or associate with these private individuals or organisations it may choose to link to. Once again, if you decide to access linked third-party websites, you do so at your own risk.
5. Reserve Rights to Modification
Fringe Frequency, and its owner, reserves the right to change the focus of its website, turn it into a registered organisation or company, to shut it down, sell it, become a paid platform, or to change the Terms of Use at our discretion.
Please check these Terms of Use regularly to ensure you are aware of any modification made by us. If you continue to use Fringe Frequency after such modifications to the Terms of Use, you are deemed to have accepted, and be bound by, the modifications. If you do not agree to such modifications, you should not use the Site.
6. Advertising and Sponsors
Fringe Frequency may display advertising, sponsored content, or receive sponsorship in future. The primary purpose of this will be to fund Fringe Frequency for all its essential production costs, staffing costs, maintenance costs, and any expansion plans its owner may have.
We are not responsible for the actions of any advertisers or sponsors. If you, the user, buy a product or service based upon a review, recommendation or link from the Site, you must take action with the exact party to resolve any issues you may have – not with Fringe Frequency, or its owner.
7. Messages to the Editor
Messages sent to Fringe Frequency via its Contact page will be kept in confidence by us, and its owner. We will seek to respond to all serious enquires to the Site, however, please understand that we may not respond to you in a timely manner, or at all.
You are responsible for any tweets or comments you make on social media platforms. Fringe Frequency, and its owner, does not endorse, affiliate itself, with you, or parties you include in messages to us, or messages linking to our content.
8. Governing Law
These Terms of Use, their subject matter and formation, shall be governed by and construed in accordance with the laws of England.
By using our Site, you agree that the courts of England will have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this policy, its subject matter or formation.
